Texas Rules Worth Knowing

The Texas Department of Insurance Consumer Help Line (800-252-3439) answers questions in English, Spanish, and other languages and can verify an agent’s license.

Prepaid funeral contracts in Texas are regulated by the Texas Department of Banking, not the Department of Insurance, which matters if you are comparing a preneed plan with final expense insurance.

Finding a Lost Policy in Texas

Texas families can find old policies through the NAIC locator and the state’s unclaimed property database (www.claimittexas.gov/).

Texas life insurance buying steps

How long is the grace period for life insurance in Texas?

Texas sets a floor for late payments. Under Texas Insurance Code § 1101.005, a life policy must give a grace period of at least one month for each premium after the first. The policy stays in force during that time.

The Texas Department of Insurance (TDI) adds a detail in its individual term and whole life checklist, citing 28 TAC § 4.602. If a policy states the grace period in days, it must allow at least 31 days.

The same checklist explains what can happen during the grace period:

  • The policy may charge interest on the unpaid premium, but the rate must be stated in the policy.
  • If the insured dies during the grace period, the overdue premium, and any stated interest, can be subtracted from the death benefit.

Hypothetical example. Your monthly premium is due on June 1, and your card on file expires. If your policy states its grace period in days, you have at least 31 days to pay while the coverage stays active. Update your payment method right away rather than waiting until the last day.

Texas life policy deadlines at a glance

The free-look rules are covered earlier on this page. The table below pulls the other key time limits from Chapter 1101 of the Insurance Code and TDI’s form checklist. These rules shape every individual life insurance Texas insurers file with TDI.

RuleTexas requirementCitation
Grace periodAt least one month; at least 31 days if stated in daysTIC § 1101.005; 28 TAC § 4.602
ContestabilityIncontestable after 2 years from issue during the insured’s lifetime, except for nonpaymentTIC § 1101.006; 28 TAC § 4.604
ReinstatementPolicies with nonforfeiture benefits: within 3 years of default (or longer at the insurer’s option), with proof of insurability and back premiums plus interest28 TAC § 4.611
Claim paymentOn receipt of, or within 2 months after, proof of death and the claimant’s right to the proceedsTIC § 1101.011; 28 TAC § 4.612
Interest on proceedsAccrues from receipt of due proof of loss until the insurer accepts the claim and offers to payTIC § 1103.104
Policy loansAvailable after 3 full years of premiums on cash value policies; a fixed loan rate may not exceed 10% a yearTIC § 1101.009; 28 TAC § 4.607

TDI’s checklist adds two buyer protections. Term life policies are not required to offer loans. And a policy may not be terminated just because loan interest was not paid on time. It can end only when the total loan balance equals or exceeds the cash value.

The same TDI checklist lists other protections that are easy to miss:

  • No forced arbitration. Mandatory binding arbitration and jury trial waiver clauses are prohibited, because they deny consumers their legal access to the courts.
  • Limited backdating. A policy may not take effect more than six months before the application date just to give you a younger age (28 TAC § 4.620).
  • Misstated age. If your age was understated, the benefit becomes what your premium would have bought at the correct age (TIC § 1101.008).
  • Term conversion. A conversion provision must state the new plan, face amount and premium rates, and must not require new proof of insurability (28 TAC § 4.618).
  • Stipulated premium policies. These must say on the first page that the policy has no cash surrender values, paid-up benefits or loan values (TIC § 884.403).

If you own term coverage that is close to ending, read what happens when term life insurance ends before the conversion deadline in your policy passes.

What are your options if a Texas policy lapses?

If a whole life policy with cash value lapses, Texas rules still give you choices. According to TDI’s checklist, the policy must let you take a cash surrender value instead of a paid-up benefit if you ask no later than the 60th day after the missed premium’s due date, once premiums have been paid for at least three full years.

If you do nothing, a paid-up option named in the policy takes effect automatically. You can pick a different available option by that same 60-day deadline.

You may also be able to reinstate. Under 28 TAC § 4.611, policies with nonforfeiture benefits must allow reinstatement within three years of default, as long as the policy was not surrendered for cash. You will need proof of insurability that the insurer accepts, plus the back premiums with interest. TDI notes that proof of insurability is not limited to good health alone.

One caution: an insurer may delay paying a cash surrender value for up to six months after you ask. If you need money quickly, ask about a policy loan instead.

Is life insurance Texas families receive taxed or exposed to creditors?

No state inheritance or estate tax. Texas repealed its inheritance tax, Chapter 211 of the Tax Code, effective September 1, 2015, under Senate Bill 752.

Then, on November 4, 2025, voters adopted Proposition 8 (H.J.R. 2), according to the Texas Legislative Reference Library. It bars the Legislature from imposing death taxes on a decedent’s property or on the transfer of an estate, inheritance, legacy, succession or gift. Because it is now part of the Texas Constitution, a new state death tax would take another statewide vote.

The federal estate tax still applies to very large estates. Under the IRS Form 706 instructions, a policy on your life counts in your gross estate if you held “incidents of ownership,” such as the right to change the beneficiary.

Strong creditor protection. Under Texas Insurance Code § 1108.051, insurance and annuity benefits, including cash value and proceeds, are fully exempt from garnishment, attachment, seizure and bankruptcy demands. That covers debts of the insured or the beneficiary.

Section 1108.053 lists the exceptions: premiums paid to defraud a creditor, a debt secured by a pledge of the policy, and child support liens under the Family Code.

Hypothetical example: a Texas family’s final expense plan

Hypothetical example. Rosa, 70, lives in San Antonio. She buys a $15,000 whole life final expense policy and names her daughter, Elena, as beneficiary. Rosa also has an unpaid credit card balance when she passes away.

Question (hypothetical)What Texas rules say
Can the card company take the $15,000?Benefits are exempt from seizure to pay the insured’s debts (§ 1108.051), unless an exception applies
Is there Texas inheritance tax?No. Repealed in 2015 and now barred by the constitution
How fast must the claim be paid?On receipt of, or within 2 months after, proof of death and Elena’s right to the proceeds (§ 1101.011)
What if Rosa died in year one?The 2-year contestable period still applies, so the insurer may review her application (§ 1101.006)

To speed things up, Elena should send the death certificate and claim form as soon as she can. Interest on the proceeds starts when the insurer receives due proof of loss. This simplified example is for education only, not legal advice.

Texas guaranty association: caps, residency and exclusions

The basic limits appear earlier on this page. The Texas Life and Health Insurance Guaranty Association FAQ adds rules that matter if you own several policies:

  • There is an overall cap of $300,000 per single life across policy types, with exceptions for certain health and non-group life limits.
  • Multiple non-group life policies are capped at $5 million to one owner, still subject to the per-life limit.
  • Medicare supplement and other supplemental health coverage is limited to $200,000.

The FAQ also explains that limits apply per insured life or policy owner. Benefits from several policies with the same failed insurer are added together before the caps are applied. Splitting coverage across two policies at one company does not double your protection.

Residency is strict. The FAQ says only Texas residents on the liquidation date are eligible. If you move away, your new state’s association generally handles your claim.

The association does not cover policies from insurers not licensed in Texas, non-guaranteed parts of variable contracts, or fraternal benefit society certificates. The governing law, Insurance Code Chapter 463, also prohibits using the association as a reason to buy insurance.

Medicare enrollment steps for Texas residents

Texas Medicare supplement rules and free HICAP help

Texas has its own rule for people on Medicare before 65. According to TDI’s Medicare supplement consumer guide, Texas law requires Medigap companies to make at least one plan available to people under 65 who have Medicare because of a disability.

TDI Bulletin B-0027-21 adds details. The six-month window begins when you first enroll in Part B (28 TAC § 3.3324). Carriers must offer Plan A on a guaranteed-issue basis, but may charge this group higher rates. At 65, you get a new open enrollment window with access to all plans. Rules for people under 65 can change, so confirm the current version with TDI.

For free, unbiased counseling, call HICAP (Health Information, Counseling, and Advocacy Program) at 1-800-252-9240, as listed in the national SHIP directory. The directory points to HICAP’s Medicare page on the Texas Health and Human Services website. Have your Medicare card and current plan details ready when you call. Talk to a licensed Octans agent about life insurance in Texas

Life insurance Texas checklist: verify the agent, then buy

TDI offers a free “verify an agent or company license” search on its company profiles page. It covers agents, adjusters, agencies and insurance companies. Check both the agent and the insurer before you share health or bank details.

If a problem comes up, contact your insurer or agent first. If that does not work, TDI’s ways we can help page walks you through its online Complaint Portal. You can also call the Help Line listed earlier on this page.

Use this checklist when you shop for life insurance Texas families can count on:

  1. Verify the agent’s and insurer’s licenses on TDI’s website.
  2. Answer every application question honestly. The contestable period is 2 years.
  3. Set up automatic payments, and know your grace period: at least one month, or 31 days.
  4. Name a beneficiary and a backup on the policy form.
  5. If a cash value policy lapses, decide on your lapse option within 60 days.
  6. Ask about reinstatement before buying new coverage. You may have up to 3 years.
  7. Keep a prepaid funeral contract and a life policy in separate files. Different agencies oversee them.
  8. Tell your beneficiary to file proof of death promptly, so the 2-month payment clock starts.
